IMPORTANT: Please read these Terms and Conditions carefully before using our Services. By accessing or using our Services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our Services.
1.1 Plan Your Baby Limited ("Plan Your Baby", "we", "us", or "our") is a company registered in England and Wales under company number 13669100. Our registered office is at 411 Oxford Street, W1C 2PE, London, United Kingdom.
1.2 We are registered with the UK Information Commissioner's Office (ICO) under registration number ZB394674. Our appointed Data Protection Officer is Marija Skujina, contactable at mskujina@planyourbaby.co.uk.
1.3 We provide telehealth fertility consultations, diagnostic testing co-ordination, and related healthcare services ("Services") via our website at planyourbaby.co.uk ("Website").

2.1 You must be 18 years of age or older to use our Services. By agreeing to these Terms and Conditions, you confirm that you meet this requirement.
2.2 To use our Services, you may be required to create an account. You agree to provide accurate, current and complete information when doing so and to update it as necessary.
2.3 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Please notify us immediately at info@planyourbaby.co.uk if you become aware of any unauthorised use of your account.
2.4 We reserve the right to suspend or terminate your account if we reasonably believe you have violated these Terms and Conditions or if doing so is required by law.
3.1 Plan Your Baby provides telehealth fertility services including, without limitation, consultations with Dr Sami and other qualified healthcare professionals, diagnostic testing co-ordination, treatment planning, and fertility guidance ("Healthcare Services").
3.2 Our Services are provided to complement, not replace, in-person medical care. Nothing in our Services constitutes a formal doctor-patient relationship unless explicitly established through a scheduled consultation with one of our registered healthcare professionals.
3.3 We reserve the right to modify, suspend or discontinue any or all of our Services at any time, with reasonable notice where practicable.
3.4 Access to our Services may require a stable internet connection and compatible device. We are not responsible for failures caused by your internet connectivity or device.
MEDICAL INFORMATION DISCLAIMER: The information and advice provided through our Services is for consultative purposes only and does not constitute a substitute for professional medical advice, diagnosis or treatment from a qualified healthcare professional who has examined you in person. If you are experiencing a medical emergency, call 999 or attend your nearest Accident and Emergency department immediately.
4.1 Our healthcare professionals are qualified and registered in the United Kingdom. All telehealth consultations are conducted in accordance with applicable UK medical regulations and professional guidance.
4.2 You agree to provide accurate and complete health information to our healthcare professionals. Withholding or misrepresenting health information may adversely affect the quality of care you receive, for which we cannot accept responsibility.
4.3 Our Services do not constitute an emergency medical service. In the event of a medical emergency, call 999 or attend your nearest Accident and Emergency department immediately.
5.1 Consultations must be booked in advance via our Website or by contacting us directly.
5.2 You may cancel or reschedule a booking by notifying us at least [INSERT NOTICE PERIOD, e.g. 24 or 48 hours] before the scheduled appointment time. Cancellations with insufficient notice may be subject to a cancellation fee as set out in our current fee schedule.
5.3 We reserve the right to cancel or reschedule appointments in exceptional circumstances, including unavailability of the consulting clinician due to illness or emergency. We will provide as much notice as reasonably practicable and offer an alternative appointment.
5.4 We may decline to provide Services to any person where we reasonably believe those Services are not clinically appropriate or where required by law.
6.1 Fees for our Services are as set out on our Website and are subject to change. The applicable fee will be confirmed to you at the time of booking.
6.2 Payment must be made in advance of the consultation or service, unless otherwise agreed in writing.
6.3 We accept payment via our authorised payment processors, Worldpay, Inc. and Stripe, Inc. We do not store your payment card details. All card data is processed directly and securely by our payment processors in full compliance with PCI-DSS standards.
6.4 All fees are quoted in Pounds Sterling (GBP) and are inclusive of VAT where applicable.
6.5 Refund requests will be considered on a case-by-case basis and should be directed to info@planyourbaby.co.uk.
7.1 All content on our Website and within our Services, including without limitation text, graphics, logos, images, audio clips, digital downloads, data compilations and software, is the property of Plan Your Baby Limited or its licensors and is protected by UK and international intellectual property law.
7.2 You are granted a limited, non-exclusive, non-transferable licence to access and use our Website and Services for your personal, non-commercial use only.
7.3 You may not reproduce, distribute, transmit, display, sell, license, or otherwise exploit any content from our Website or Services without our prior written consent.
7.4 Any feedback, suggestions or ideas you provide to us regarding our Services may be used by us without restriction or compensation.

9.1 Our collection and use of your personal data, including health data, is governed by our Privacy Policy, available at planyourbaby.co.uk/privacy-policy and incorporated into these Terms and Conditions by reference.
9.2 We are registered with the UK Information Commissioner's Office (ICO) and process personal data in accordance with the UK GDPR (Data Protection Act 2018) and PECR. Our appointed Data Protection Officer is Marija Skujina (mskujina@planyourbaby.co.uk).
9.3 By using our Services, you agree to the processing of your personal data as described in our Privacy Policy.
9.4 You have rights in relation to your personal data including the right of access, rectification, erasure, restriction of processing, data portability, and the right to object. To exercise any of these rights, contact us at info@planyourbaby.co.uk or at mskujina@planyourbaby.co.uk.
9.5 You have the right to lodge a complaint with the ICO at ico.org.uk or by calling 0303 123 1113.
10.1 We employ comprehensive security measures to protect your personal and health data, including: AES-256 encryption at rest; TLS/HTTPS encryption for all data in transit; Role-Based Access Control (RBAC); Multi-Factor Authentication (MFA); AWS GuardDuty intrusion detection; DDoS protection; and regular independent vulnerability assessments. 10.2 In the event of a personal data breach that is likely to result in a high risk to your rights and freedoms, we will notify you without undue delay and notify the ICO within 72 hours, in accordance with our obligations under the UK GDPR.
11.1 To the maximum extent permitted by applicable law, Plan Your Baby Limited and its directors, employees, agents, and clinical partners shall not be liable for:
11.2 Nothing in these Terms and Conditions excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any liability that cannot be excluded or limited under the Consumer Rights Act 2015 or other applicable law.
11.3 Our total aggregate liability to you in connection with your use of our Services shall not exceed the total fees paid by you to us in the 12 months immediately preceding the event giving rise to the claim.
12.1 Our Website may contain links to third-party websites and services. These links are provided for your information and convenience only. We have no control over third-party websites and do not endorse or make any representations about them.
12.2 We work with third-party healthcare partners, technology providers and payment processors as described in our Privacy Policy. These third parties operate under their own terms and conditions and you are encouraged to review these.
13.1 We may update these Terms and Conditions from time to time. We will notify you of any material changes by posting a notice on our Website and, where appropriate, by email.
13.2 Your continued use of our Services following notification of changes constitutes your acceptance of the updated Terms and Conditions.
13.3 The current version number and date of last update are shown at the top of this document.
14.1 These Terms and Conditions will remain in effect while you use our Services.
14.2 You may stop using our Services at any time.
14.3 We may terminate or suspend your access immediately, without prior notice, if you materially breach these Terms and Conditions or if we are required to do so by law.
14.4 Upon termination, all rights granted to you under these Terms and Conditions will immediately cease. We will handle your data in accordance with our Privacy Policy and data retention obligations.
15.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales.
15.2 Any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales.
15.3 We are committed to resolving complaints fairly. Please contact us at info@planyourbaby.co.uk in the first instance. If we cannot resolve your complaint, you may refer it to the ICO or another relevant regulatory authority.
16.1 Entire Agreement: These Terms and Conditions, together with our Privacy Policy and Cookies Policy, constitute the entire agreement between you and Plan Your Baby Limited regarding your use of our Services.
16.2 Severability: If any provision is found to be unlawful, void or unenforceable, that provision shall be deemed severable and shall not affect the validity of the remaining provisions.
16.3 No Waiver: Our failure to enforce any provision shall not constitute a waiver of our right to enforce it in the future.
16.4 Assignment: We may assign our rights and obligations without restriction. You may not assign your rights under these Terms without our prior written consent.
16.5 Force Majeure: We shall not be liable for any delay or failure caused by events beyond our reasonable control.
